Q: What is an expungement?

A: An expungement means the extraction and isolation of all records on file within any court, detention or correctional facility, law enforcement or criminal justice agency concerning your detection, arrest, detention, trial, etc. or an offense within the criminal justice system. Q: What can you expunge?

A: Complaints, warrants, arrests, commitments, processing records, fingerprints, photographs, index cards, “rap” sheets and judicial docket records.Contact us today (201) 365-8500!


Q: Who can get their record expunged?

A: Persons who have any of the following:
  • Arrests not resulting in a conviction (bars to expungement may apply)
  • Certain indictable offenses except for certain serious offenses and certain distribution of CDS (bars to expungement may apply)
  • Disorderly Persons Convictions and Petty Disorderly Persons Convictions (bars to expungement may apply)
  • Municipal Ordinances Convictions (bars to expungement may apply)
  • Motor vehicle offenses cannot be expunged


Q: What is the Procedure?

A: The procedure involves filing a petition which must state all information regarding prior convictions, either indictable or disorderly, as well as any pending matters and a list of all arrests whether in state or out of state and even if the arrest did not lead to a conviction. Q: Can an expungement be denied?

A: Yes. Some factors which may contribute to a denial include:

  • Time period required by law has not been met. This time period often does not begin until all confinement and probation has been completed and fines are paid.
  • Additional convictions exist
  • A previous expungement exist
  • Pending arrest(s)
  • Conviction of a sexual offense


Q: How long does the process take?

A:  There is no set time frame so each petition will be treated on a case by case basis; however, if there are no objections to your expungement petition and you are forthright with your information, an expungement order may be granted within a matter of a few months.


Q: What is the effect of the expungement?

A:  For many purposes, the conviction is treated as if it did not happen, but records are not destroyed, only isolated, and may play a role in certain limited future court proceedings, for example, setting bail or imposing sentence, etc.
